How long is an Italian residence permit valid?

Checked on

Italian law caps a work permit at one year for a fixed-term contract and two years for a permanent one, and self-employment and family-reunification permits at two years; renewals of those last three can reach three years. Study permits cover the course. The long-term EU permit is valid for ten years for adults and renews on request.

Work permits

Article 5(3-bis) of the Consolidated Immigration Act says a work permit is issued after the residence contract (contratto di soggiorno) is signed and lasts as long as that contract, up to nine months in total for seasonal work, one year for a fixed-term employment contract and two years for a permanent one. For the permanent-contract permit, the same paragraph says each renewal can’t exceed three years; otherwise article 5(4) caps a renewal at the length of the first permit.

Self-employment and family

A self-employment permit, issued on the consulate’s certification that you meet the requirements of article 26, can’t be valid for more than two years (art. 5(3-quater)). A family-reunification permit also has a two-year cap (art. 5(3-sexies)). For both, each renewal can’t exceed three years.

Other permits

For permits not issued for work, the law says the length is the one in the entry visa, within limits: no more than three months for visits, business and tourism; no less than the length of a study or certified training course, with a yearly progress check, and extendable by twelve months after the course; in other cases, no longer than the documented need (art. 5(3)). Article 5(4) adds that, unless other terms apply, a permit is renewed for no longer than its initial length.

Long-term EU residence permit

Article 9(2) says the long-term EU residence permit is permanent as a status, valid for ten years as a document (five years for under-18s), and is automatically renewed at expiry when you apply with new photos.
