Does Portugal's 2026 nationality law change apply to citizenship applications already submitted?

Checked on

No. Lei Orgânica 1/2026 entered into force on 19 May 2026 and says applications already pending on that day are decided under the previous Nationality Law. For new applications, legal residence rose from five years to seven (CPLP and EU nationals) or ten years (others), and the time spent waiting for a first residence permit no longer counts.

Pending applications keep the old rules

Lei Orgânica 1/2026 says it takes effect on its entry into force, except that “administrative procedures pending” on that date are governed by the Nationality Law in its wording before the amendment. The law entered into force on the day after its publication, so the cut-off is 19 May 2026. The Ministry of Justice’s nationality page repeats that date.

What changed for new applications

Comparing art. 6 and art. 15 before and after the amendment:

Rules still to come

Lei Orgânica 1/2026 requires the Government to amend the Nationality Regulation (Decreto-Lei 237-A/2006) within 90 days of 18 May 2026. The Ministry of Justice’s page says some changes depend on that complementary regulation.
