What can I do if Serbia refuses my temporary residence permit?

Checked on

You can appeal within 15 days of receiving the refusal. Serbia's Law on Foreigners says you file it through the police unit that decided, in writing, in Serbian, with the prescribed fee, and the Ministry of the Interior decides. The appeal suspends the refusal, and after the appeal you can bring an administrative dispute in court.

Why applications are refused

The law requires refusal of a temporary residence application or extension when, among other reasons: your passport is valid for too short a time; a general condition (such as means of support or health insurance) is missing; you are under a removal measure, expulsion or entry ban; security reasons require it; there is a justified suspicion you won’t use the residence for its purpose; your travel document is forged or your evidence was forged or obtained illegally; or there are reasons to believe you won’t respect Serbian law. For an extension, it is also refused if you did not use your previous residence for its basis (Zakon o strancima, art. 45(1)). The portal’s guidance lists the same grounds.

For a single permit, the grounds also include a reasoned finding by the employment organisation that the employment conditions are not met (art. 46đ(1)).

When deciding, the law requires the authority to weigh the circumstances of each case, including your personal, family, economic and social situation and the length of your previous stays (art. 65(1)).

How to appeal

You file the appeal through the police unit that refused you, within 15 days of receiving the decision. It must be in writing and in Serbian, with the prescribed fee paid. The Ministry of the Interior decides it (art. 45(2)–(4)). The appeal suspends the refusal (art. 45(5)), and if your original application was filed on time you may stay in Serbia until the appeal is decided (art. 41(7)).

If the Ministry rejects the appeal, you can bring an administrative dispute in court. For temporary residence, starting that dispute does not suspend the Ministry’s decision (art. 45(6)).

If your residence is cancelled later

If refusal grounds come to light after your residence was granted, the authority issues a decision ending your right to temporary residence. It may set a deadline of up to 30 days for you to leave Serbia and may impose an entry ban. You can appeal within 15 days; the appeal suspends the decision, except for the deadline to leave (art. 66(1)–(8)).
