Can I spend long periods outside Serbia while holding a temporary residence permit?

Checked on

Serbia's Law on Foreigners sets no minimum number of days for temporary residence, but you must live in Serbia according to your permit's basis, and an extension can be refused if you did not use the previous permit for that purpose. For permanent residence, absences may total ten months, or six months at once, over three years.

No day count, but a purpose test

Serbia’s Law on Foreigners does not set a minimum number of days you must spend in Serbia on temporary residence. Instead, it requires you to live in Serbia in line with the basis on which your residence was granted (Zakon o strancima, art. 40(3)); single permit holders have the same duty (art. 46a(4)). When you apply to extend, the authority must refuse if it finds you did not use your previous residence, or single permit, in line with that basis (arts. 45(1)(5a), 46đ(1)(8)).

What the government’s guidance says

The Welcome to Serbia portal answers employers asking whether a worker can spend less than half the permit’s time in Serbia. Its guidance says an extension may be refused if the previous stay was not used for its purpose, that the law sets a misdemeanour penalty for not living in line with the basis, and that the justification for being absent may be raised when the single permit is extended. Each extension is assessed on its merits, including the reason for the absence.

The law also requires the authority to weigh each applicant’s personal, family, economic and social circumstances and the length of previous stays (art. 65(1)).

Absences and permanent residence

Time abroad matters more for permanent residence. The law requires three years of continuous temporary residence, and counts as continuous an effective stay in Serbia with several absences totalling up to ten months, or a single absence of up to six months, in those three years (art. 67(2), (5)). This applies to single permit holders too (art. 67(9)).
