Can I apply for a Spanish student permit from inside Spain?

Checked on

Yes, for higher education. Spain's immigration regulation lets an adult who is legally in Spain apply there, at the immigration office of the province where studies start, at least two months before studies begin and two months before your current legal status ends. Spain has two months to decide; no answer means refusal. Your legal status continues meanwhile.

Who can apply without going back to a consulate

Spain’s immigration regulation (Real Decreto 1155/2024) says you can apply for a long-stay student authorisation from outside Spain, through a visa, or from inside Spain if you hold a residence authorisation (art. 54.1).

For higher education (university or non-university studies leading to a recognised higher education degree, art. 52.1.a) and for specialised health training (art. 58), you can also apply from Spain as long as you are there legally. In that case you must be an adult and apply at least two months before your studies start (art. 54.1). Other study types, such as language courses, secondary school or volunteering, don’t have this option unless you already hold a residence authorisation; the exception is one kind of professional training when its own resolution allows it.

How it works

You apply on the official form at the immigration office of the province where you will start your studies, in person, through a representative or online. The application must go in at least two months before your current legal situation expires, with documents proving the visa requirements of art. 35 (except holding the authorisation and paying the visa fee) and the study requirements of art. 53, such as admission and payment of enrolment fees (art. 54.3).

Applying extends your current legal situation until the decision. The office has two months to decide and notify you; if it doesn’t answer in that time, the application counts as refused (art. 54.3).

When your university applies for you

A higher education institution listed in the Registro de Instituciones y Centros de Enseñanza Superior can file the application electronically for a student who is legally in Spain. You are then excused from proving admission and fee payment yourself, though the administration may check. The deadline to decide is 15 days; no answer means refusal (art. 54.6).

After approval

If your authorisation is valid for more than six months, you must apply in person at the competent police station for your foreigner identity card (TIE) within one month of the grant (art. 54.9).
