How long do I have to apply for my TIE card after arriving in Spain?

Checked on

Spain's immigration regulation says anyone with a visa or permit to stay more than six months must apply in person for the foreigner identity card (TIE) within one month of entering Spain, or within one month of the permit being granted or taking effect. After a renewal, the month runs from notification of the renewal.

The rule

The regulation of Spain’s immigration law (Real Decreto 1155/2024) says the TIE (tarjeta de identidad de extranjero) is the document that identifies a foreign national and proves their legal situation in Spain. If you hold a visa or an authorisation to stay more than six months, you must request it personally within one month. The month counts from your entry into Spain, or from the date your authorisation is granted or takes effect.

The articles for individual permits repeat the same one-month rule: for the non-lucrative residence permit it runs from entry into Spain (art. 63.5); after a renewal it runs from notification of the renewal decision (art. 64.9).

Where and what you pay

The regulation gives the police (Dirección General de la Policía) the job of issuing the TIE at the police station where the file was handled or the decision was notified. You must prove you are the person the card is for and that you have paid the legally set fees (art. 209.11). Where the permit only takes effect once you are registered with Social Security, the police check that registration before issuing the card.

If you miss the month

The regulation says failing to meet the TIE obligations leads to the sanctions regime of Ley Orgánica 4/2000 (art. 209.4). It does not name a specific fine for applying late.
