My Turkish residence permit was refused. What happens next and can I reapply?

Checked on

The refusal is notified to you, your legal representative or lawyer, and the notice must explain how to object. Turkey's regulation gives you a free document to stay up to 10 days. If a renewal is refused and you don't leave within 10 days, the law orders a deportation decision. Reapplying within six months needs a new reason.

Right after a refusal

The law requires the governorship to notify the refusal, non-renewal or cancellation to you or to your legal representative or lawyer, and the notice must explain how you can effectively object (art. 25(2)). The regulation says that when a permit is refused or not renewed you receive a document, free of charge, that lets you remain in Turkey for up to 10 days (art. 22(11)).

The law then sets the consequence for renewals: if your renewal is refused and you don’t leave Turkey within 10 days, a deportation decision is taken (art. 54(1)(j)).

When your situation is weighed

Before refusing, not renewing or cancelling a permit applied for inside Turkey, the authority considers your family ties in Turkey, how long you have lived there, the situation in your country of origin and the best interests of any child, and it may postpone the decision (art. 25(1)). The regulation says that in that case you receive a fee-free document allowing you to stay for one month, which can be extended month by month while the situation continues; the residence fee is charged for that time (art. 22(18)).

Challenging a short-term permit refusal

The law refers to court applications made by the foreigner, their legal representative or lawyer against the refusal or cancellation of a short-term permit, and sets procedural rules for them (art. 31(7)).

Reapplying

The regulation says that if you reapply within six months of a refusal or cancellation, you must give a new reason for the permit (art. 21(10)). The Presidency of Migration Management’s FAQ puts it this way: you cannot apply again for the same purpose within six months, but while your legal stay continues you can apply for a different purpose.
